How Long Do I Have To Collect On My Case?
Personal injury cases have time limits. The laws that govern these time limits are called "statutes of limitations."
The general rule for a statute of limitations in a personal injury case is two years from the date of accident. This means that if you are injured in an accident, and your case is not settled, you must file suit within two years from the date of accident or your claim against the adverse party is terminated. However, there are exceptions. For example, minors who are injured have until two years past the age of majority in which to file suit (20 years old).
While the general rule is two years, time limits vary in the event of the subsequent death of the injured party, medical malpractice, and in some cases, the statute of limitations can be tolled or begin to run from the date of discovery.
