Premises Liability - Elevators and Escalators
Unfortunately, accidents can occur on elevators. We have seen instances of serious injury when electronic or mechanical devices fail to work properly. Nothing is truer than in cases involving elevators and escalators.
As with busses, planes and trains, escalators and elevators are treated by the law as owing a high public duty of safety and performance. When they fail, injuries result.
When these failures occur, substantial injuries can result. Usually, the difficulty in handling these cases lies in the fact that the property owner is saying it’s not their fault, and so is the elevatore/escalator company. It usually becomes a question of who was required to perform the elevator maintenance – and that usually relates an interpretation of the maintenance contract.
