Oral Argument at 11th Circuit Court of Appeals May 17, 2016

The 11th Circuit Court of Appeals has requested oral argument in the case of Teri Hinkle v. Encore Capital Group, Midland Funding, and Midland Credit Management.

Ms. Hinkle's case in federal district court in Georgia was dismissed on motion for summary judgment filed by the Defendants. Hinkle sued for violations of the FDCPA and FCRA. Hinkle maintains that summary judgment was improper because evidence was produced for which a proper foundation was not laid. In addition, as a matter of law, she maintains that Defendants did not have any original account-level documentation and therefore could not conduct a reasonable investigation into whether the two accounts that allegedly belonged to her.

Oral argument for the appeal is set for the week of May 18, 2016.
