Taking Legal Action

When consumer reporting agencies and furnishers fail to convey information, properly conduct reinvestigations and continue to report erroneous information you may be entitled to one or more of  the following:

1. Statutory damages

2. Actual damages

3. Punitive damages

4. Attorneys fees, and 

5. Court costs.

Actual damages may include emotional pain and suffering, and humiliation, and credit damage, resulting in paying higher insurance premiums, interest rates, denial of credit, etc.

​

Punitive damages are alsp available in those cases in which there was willful misconduct in the actions of the CRAs, the furnishers, or both.

Damages are availabe under federal law, as well as state law, depending upon where you live and pursuant the specific nature of those statutory protections.
